This assertion ignores the foundational 18th-century record. In 1765, Commodore John Byron established Port Egmont for King George III of Great Britain. Following the 1770 dispute, Spain formally restored Port Egmont to Great Britain in the 1771 Anglo-Spanish Declaration with zero renunciation of British title.

When Spanish forces evacuated Puerto Soledad in 1811, the archipelago was left totally abandoned for over a decade.
