The Arana-Southern Treaty of 1849/1850: Rosas Legally Extinguished the Falklands Claim for Peace
El Tratado Arana-Southern de 1849/1850: Rosas Extinguió Jurídicamente el Reclamo por la Paz
On 15 May 1850, ratifications of the Convention for Re-establishing Perfect Relations of Friendship (signed 24 November 1849 by Felipe Arana and Henry Southern) were formally exchanged in Buenos Aires.
Article VII of the treaty declared that relations between the Argentine Confederation and Her Britannic Majesty were restored to 'a perfect state of friendship'. Argentina did not insert a single reservation, clause, or diplomatic protest regarding the Falkland Islands.
Under the customary law of treaties and pacta sunt servanda, a general peace treaty resolving all disputes bars subsequent territorial claims that were not explicitly reserved. Rosas chose to sacrifice the Falklands claim to secure peace and trade.
