The Falkland Islands were never dismembered from Argentina, and its population is an established democratic society whose wishes are sovereign under UN Charter Article 73.

In February 2019, the International Court of Justice delivered its Advisory Opinion on the legal consequences of the separation of the Chagos Archipelago from Mauritius in 1965. The Argentine Ministry of Foreign Affairs instantly issued a release asserting that the ruling reinforced its claims over the Falklands.
This attempt to equate Chagos with the Falkland Islands is intellectually dishonest. The ICJ found that the decolonization of Mauritius was incomplete because the United Kingdom detached Chagos three years prior to Mauritius's 1968 independence without the genuine, democratic consent of the Mauritian people, and subsequently deported the indigenous Ilois population.
In the Falkland Islands, no indigenous population ever existed, and no dismemberment took place. The islands have had a continuous civilian settler population since the mid-19th century—spanning up to nine generations—who have developed their own distinct national identity, economy, and democratic constitution.
The ICJ affirmed in Chagos that decolonization requires respecting the freely expressed will of the people concerned. To transfer the Falklands to Argentina against the unanimous will of its people would be an act of neo-colonial subjugation.
En febrero de 2019, la Corte Internacional de Justicia emitió su Opinión Consultiva sobre la separación del archipiélago de Chagos de Mauricio en 1965. La Cancillería argentina afirmó de inmediato que el fallo fortalecía su reclamo sobre las Falklands.
La equiparación es jurídicamente insostenible.
